Will a court accept false witness and no written proof of payment

18-Jul-2023 (In Landlord/Tenant Law)
A man had been occupying my premises on oral agreement without any advance. I filed a petition for evicting the place. In the counter, he has stated that he paid Rs. 1.5 lakh advance for which he has not written receipt. but he says that he can produce witnesses for paying the advance. Will the court of law agree to his claim of paying advance amount without written receipt ?

In the absence of any written rental agreement, it will be your word against his in establishing your mutual rights and claims in a court of law. Ask your counsel to oppose his move for producing witnesses, and counter them effectively if produced.
