What to do if my tenant is not vacating the place

We have given our shop to a tenant and he is not vacating the shop and also not giving is the rent. We already put up the case but nothing happen. It's been 40 years now. What should we do next?

Have u file it for eviction of tenant for non payment of rent?
What about ur tenancy agreement, is there any clause that either party can give 1 month notice to other. If yes, have you send him legal notice to vacate premises?
