Tenant not ready to pay rent nor vacating

Hi Sir/Madam, We have rented house and the tenant has not paid full advance amount (sum of 50000 rs is been paid out of agreed 1lakhs rupees) in the month of June 2016 and is not paying rent from last 4 months and whenever we ask to vacate, they keep saying some date. tenants has approached police station and asking for additional time duration. Also not ready to pay the rent amount Please provide valuable suggestion as how can we go ahead on the problem/matter.
Upon the expiry of the agreement, the tenancy automatic becomes a month-to-month tenancy terminable upon a notice to the said effect. If the tenant refuses to vacant the premises despite the expiry of the notice period, remedy lies in a suit for eviction.
In case the tenancy is governed by the provisions of Delhi Rent Control Act, the above query is not capable of being sufficiently/adequately answered with the given set of facts.
