Tenant claimed would leave but didnt leave and created an issue

Was leasing an apartment to someone who was really inconsistent on paying rent and hadnt paid for months. Kept telling him to pay rent and leave. Made excuses first then said he'll leave by a date but then refused to leave. I was not in town and sent a relative to collect the keys and they decided to get locks changed. But then let mother of tenant in claiming she's old and needs to relax even if they're not let in. Finally tenant also entered and are now claiming we tortured his mom. Pls advice

Hello Sir. You may separately file a suit for possession, an injunction, and mesne profits for the eviction of the tenant. Whatever they are claiming is a separate issue, and they can have their own legal remedies, but it won’t have any effect on the tenant-landlord relationship.

In the suit itself, you may file an application under Order 12 Rule 6 for eviction on the basis of the admission of the party for quicker eviction.

We can file a civil suit for recovery of possession of the property and eviction of the tenant for non payment of rent. Tenant cannot dictate the landlord. If they try to harass you for any false case, you can seek help from local police. For any further query feel free to contact
