Recovery of rent & eviction of tenant

The tenant is not paying rent for the last 5 months for my shop taken on rent by him He is also not opening the shop since then. In lease deed there is a clause that if the tenant does not pay rent for two consecutive months the lessor gets right to evict the lessee from tenancy. My query is how to enforce this right without going to court. Because courts take a long time to decide the case. Moreover, service of summons to defendant is a tedious task. Mostly people avoid taking summons & go under ground. Also, the ex-parte decree if awarded it is very difficult to execute the decree.

Well issueissur notice for Eviction for fifteen days and file case for Eviction you have a right to vacate the suitr ptemisis without Any delay the best part in your case is you have rent agreement for a period of months you can force it wi th the help of court and not in othry way for furthrrvdetsils you can contact me

You can't take possession of shop legally without court order. Exparte orders are executed easily in case of eviction. The case with not take more than 6 months. We can suggest you only the legal way. Best of luck
