Pagadi System in Mumbai - Vacant Flat in Mumbai. Need Guidance

02-Jan-2024 (In Landlord/Tenant Law)
My father has a flat in pagadi system. We are paying the rent on time. However, it is currently vacant. We come every 2 months, stay for a week and then leave. Now, landlord has said either you have stay continuously or sell the flat to him. He says that you cannot come every 2 months and stay for a week. He said he will sue and evict us. So, can we keep our flat vacant in pagadi system and come every 2 months and stay for a week or will it be an issue

Well, there is no law as such, which says, that, in a Pagadi flat, a tenant has to live continuously and he cannot come and go. Your Landlord is merely trying to pressurize you, so that, you can peacefully evict his house. However, you seek my legal assistance to protect you from being evicted. I will serve your Landlord a legal notice to stop pressurising you by using different tactics to compel you to evict you from tenanted premises.
