My tenant is not vacating my shop. What are my legal options

23-Aug-2023 (In Landlord/Tenant Law)
I have given my shop to a person. Last 1 year before we have verbally spoken to him to vacate the shop. But he ignored it. Then we send a legal notice to him twice. but he refused to accept the same. Now he directly refused to vacate the place and threatening us to kill. Even he is not paying rent from last 1 year. Rent agreement has also expired about 1 year ago.

Landlorod has all the rights to get his house vacated. In this case you need to look upon the terms of the agreement. If the agreement says that you have to give one month notice then you can give tehm the notice for vacating. If they donot comply with the notice then you can send a legal notice and then you can file a suit for possession under specific relief act
