Landlord sent legal notice for unfair increase in rent amount

2013 landlord made a agreement asking for 10% raise in rent every year but without even raising the issue has sent a lawyer notice to pay new rent which was rs.3690 for 150 sq.ft first floor to rs.10500 now my business has come down drastically to 25% (electrical switch board cutting service) due to slump in real estate

You can approach the Rent controller court for fixation of fair rent under section 4 of the TN buildings (lease and rent control) Act,1960. The fair rent for any non residential building should be 12% per annum on the total cost of building.

A land lord cannot fix a rent unilaterally provided any clause in the rent agreement entered by both of you. if you are accepting the ratio of enhancement of rent , then you can file a petition before the jurisdictional rent controller court for fixation of fair rent. Before that you have to sent a reply legal notice thro an advocate to your land lord for not accepting the enhancement.
