Garbage Collection Penalty charged by Housing Society

12-Dec-2023 (In Landlord/Tenant Law)
Hello, I have been staying at my rented premises for 3 years now. A year ago the society came up with some weird laws about garbage collection and started charging us penalty for default. As soon as I received the first notice about the rules, I wrote back clearly mentioning that following this rule will not be possible for me because of my working hours. The society did not respond to any of emails but continue charging me panalties. Is there a legal solution to this issue?

Well, if you are not putting any garbage in the premises dumping yard or using that then you can ask for exemption otherwise you have to clear your garbage by yourself and ask them to not to impose any penalty. Otherwise you dnt have any right to put garbage and create nuisance by not cleaning the same. Though they dnt have a right to impose penalty but they can complaint against you to the municipality and they will come and take action against you and impose penalty
