Commercial activities in residential premises

04-Oct-2023 (In Landlord/Tenant Law)
Pagri building in Mumbai. Common bathroom toilets on each floor. Landlord has given part of the floor premises for commercial establishment, Problem is the offices/shops are kept open till 2200-2240 hrs on a daily basis. Since there are a large number of units own person's present outside these establishments on a daily basis, female residents find it inconvenient to use the bathroom/toilets till the offices shut for the day and unknown strangers leave. Landlord is reluctant to control operational hours of these establishments. local police station says it is civil issue bet landlord and tenants and landlord must handle it . No complaint can be lodged. Kindly advise.

This is my response to you:
1. Firstly you must know that the person occupying the premises must obtain license for running commercial premises;
2. Also ask if police verification process has been completed or not?
3. Then if the building is as for residential purposes and used for commercial activities then you can file a formal complaint to the municipal authorities;
4. You can also file an NC if not FIR for breach of peace being caused;
5. Some of the women can also complain about harassment if there is any;
6. This can be both civil and criminal matter, so consult a local lawyer and take steps.
