White washer got injured during work, filed a complaint against me

Hi sir, I hired a Safediwala for white washing in our home verbally. It was a verbal contract. He did the interior white washing for 3 days and on the exterior white washing he brought two boys along with him, he started with the 2nd floor and used Jhoola to do exterior white washing...suddenly one of the boy fell down and got his leg broken and some spinal injuries. We sent him to the Government hospital but Safedi wala filed a case againt us in 100 number...now the safediwala is looking for the payment of damages. Now tell me what to do...what police will do and what are its consequences? Kindly suggeat us what to do? Thanks

If you have correctly classified the worker as an independent contractor, you do not have to worry about workers’ compensation issues. However, an injured independent contractor who can show: a) a causal connection between that your actions or omissions and the injury; and b) that your actions and omissions amounted to negligence might result in you havaing to defend a lawsuit
