12-Jan-2023 (In Labour & Service Law)
Hi, i joined a company in Mumbai name MRSS India, in which i was having my term bonus which i used to get by end of 6th month. the term bonus was part of your salary and not at all related to your performance. It been more than 10 month the company hasn't given me my bonus. I told the company that if they dint release my bonus i ll resign and i resigned immediately. Also i do have relieving letter from the company. How can i get my term Bonus. What legal procedure i have to take?

According to your situation you are eligible to the term bonus till the continuance of your employment though, as it not a performance based award, thus, you have to file a civil suit for recovery of the said term bonus also, you can send them a legal notice thereby challenging their denial of the term bonus on the ground of discrimination and seek compensation . Further you can file a writ petition thereby seeking infringement of fundamental rights
