My missing father has been terminated from his services what to do.

My Father is mussing since march 21,2001 . He was employee of SECL subsidiary of CIL On 21 march 2001 he went for duty he did not come return in home till date.after that we lodged his mussing complaint in our neatest police station after some time we informed management of colliery by registered dak .knowing all fact about missing employee (my father) ,management stand a departmental enquiry against my father.he gave the charge sheet in my home he charged that Mr ABC is absent a long time without reason and he is habitual absentee. But my father is mussing then can he go to for duty.he started departmental enquiry in December 2001 and management is terminated my father in December 2004 after 3yera .during this duration on spetmber 2004 we go to labour court /ALC and we lodge a writ against management .in this writ we demand commpanstion appointments and other facilities. And management is not take any approval for ALC.. Is this termination is false Pls help
