Sir, in order to answer your query I need to understand the structure of your organisation. In general employees need to work at least 5 years to claim gratuity. But to give an accurate opinion I need to understand the company structure. Feel free to reach out and provide details to assist you better.

As per the Payment of Gratuity Act, 1972, continuous service of 5 or more years under the same employer qualifies an employee for gratuity. If all companies are under the same ownership and your service is continuous without a formal break, you may be eligible to claim gratuity based on total service duration. However, proper documentation showing continuity under the same employer is essential. You may consult a legal professional with your appointment letters and salary records for clarity.

Do seek a detailed legal consultation from an Advocate having expertise in employment cases. Do engage and brief about the facts of the case to the lawyer. Need to legally peruse the contents of your employment letters and transfer letters as well before tendering our opinion
