Company not giving my salary

I've been working in a software company from past 40 days. Company have not paid my salary Is it possible to my salary back.
For that purpose send them proper mails and then a legal notice through the advocate to clear your due payments and in absence to clear the same you can come up to the court for due payment and compensation .you can file a suit for recover against the company.

MY OPINION THAT you have working under a private company, the company is a registered software company ,so you have all authentic documents for your service i think, so you have legal entity to challenge in legal field for recovery of your legitimate salary.
