Company hasn't paid notice period dues.
04-Jun-2026 (In Labour & Service Law)
So I put in my notice on 15th May, with the notice period being 1 month, but the company forced me to leave on 18th May itself. They have paid me my salary till 18th May, but I want to know if I should be paid till 15th June. And my remaining leaves havn't been encashed either.
And it says in the contract: "Your notice period will be 1 month. Either party may terminate the employment by paying the equivalent basic salary for the time period in question, subject to the company’s discretion."
Yes, according to the employment contract clause mentioned by you by choosing to terminate your services early on May 18 instead of letting you serve the full notice period until June 15, the company is contractually obligated to pay you the equivalent basic salary for the unserved period (from May 19 to June 15) as notice pay in lieu. Furthermore, you have a statutory right to encashment of your earned, remaining leaves upon cessation of employment. Send a formal demand letter to the company demanding payment of your full and final settlement, including notice pay and leave encashment. If they fail to comply, you can pursue legal recourse through a lawyer's legal notice or by filing a claim with the labor commissioner's office. Refrain from sharing your contact details here
Based on the clause, if the company asked you to leave before completion of your 1-month notice period, you may have a claim for notice pay up to 15th June and encashment of earned/eligible leaves as per your employment terms.
I can review your employment contract and help assess your legal rights and recovery options.
Based on the clause, if the company relieved you on 18th May instead of allowing you to serve the full notice period, you may have a claim for notice pay up to 15th June (subject to the exact contract terms and company policy).
You may also be entitled to encashment of earned/privilege leaves as per your employment contract and applicable labour laws; I can help review the documents.
