Company denied earned leave encashment due to change in policy

19-Oct-2023 (In Labour & Service Law)
I was working with a company one month ago.yesterday I went for a full and final settlement and they denied to give earned leave encashment on the grounds that the companny leaves policy has been changed with effect from March 2016 and company only encash the leaves which are more than 30. Please note that I have 24 earned leaves. I joined that company on 20th September 2014,that time our company's HR forwarded the leaves policy that clearly stated that at the time of resignation the company will encash the due earned leaves. The new policy which they referring to is not shared with the employees. Please advise if I can claim the amount due. Look forward for your immediate response.

Did this new policy was floated before your resignation from the co.? Also what's the date of your resignation and the date of coming into force of this new leave policy? Incase the new policy was floated after you resigned, you will be continued to be governed under the old rules and hence, will be entitled for the refund. pls shoot a legal notice raising your grievances asap. Incase this fails to redress the grievance, move a labour complaint.
