Can a PSU charge 3 months penalty against former employee

I quit a PSU job at one month notice against standard 3 months notice that is required. The HR slapped a 03 months penalty in addition to 02 months basic plus DA against 02 months short in notice period. I have two questions. 1. Is it valid for a PSU to slap a 3 months penalty. 2. The company used an old office order issued in 2012 regarding amendment in service rules. There is updated service rules manual issued in 2014 that available on company's employee portal. The updated manual does not have any mention of penalty while the old order has. Please guide how I can take it forward legally.

Yes, a penalty can be imposed after 3 months as well. To get a better clarification you may file a RTI asking them service rules regarding penalty and other information you seem important. we would like to review the papers sent to you to have better understanding and clarity to advise you better.
