Wife left home with her own accord and filed maintenance

Application filed under sec 125crpc stating not working and dependent on family members. After showing document from husband side wife admits of working but from the said work not having any source of income. My question is in this circumstances is wife eligible to get maintenance.

under law a husband is liable to maintain his wife and if wife is gainfully employed then only she may not claim maintenance, obviously if if she earns well there is no question of her asking for the maintenance however, the situations seems not so thus she has filed case for maintenance and which husband has to pay, ultimately all depends on evidences and record as well..

Hello sir I have gone through your query . In this case if the wife is educated and earning some amount of money on paper . Then maintenance may not be awarded. In other words if it is proved that the wife can very well take care of her basic needs and expenditure then no maintenance may be awarded. For any further information feel free to reach out to us
