Wife has moved to her Parents house (both working, no kids, Hindu)

Hello, me and my wife are from Mysore and we got married 1 year 3 months back, I had clearly explained to my wife before marriage that we need to share our household expenses and my mother will be staying with me, After marriage - her expectations began to grow and so as my expenses so I request her to share the house hold expense and would have frequent argument regarding the financial issues, now she has left me to her parents house 4 months ago and would return only if I relocate to near to her parents house. My Inlaw are very abusive and I do not wish to relocate as the tensions may increase. -Can I apply for divorce? -What will be the backlash from my wife's end? -Since we both are working should I have to pay any maintenance (no kids) -my wife is abusive towards me and my mother but openly does admit that she dislikes my mother staying with me (she is aware of the divorce law). - can my wife file false domestic violence case - can I file defamation case against the false DV

okay I understand your questions so now you will file ready to file divorce case yes it is possible and you are thinking she can file maintainance case right but you are told your message she isn't working there for you will not paid maintainance becouse she is working and your case is fit for divorce if you need any legal help contact me thank you

Dear Sir, Since your wife is working there are less chances of maintenance to her by you. If your salary is not more than three times of her salary. You may file divorce on the financial grounds and domestic grounds of cruelty. It is better to file Divorce by you at the first instance and approach High Court to get stay of cases if she files any against you.

You can apply for divorce... it's advisable first you file for conjugal rights thereafter if she refuses to join you can get divorce easily... feel free to consult in Mysore if you need further guidance in this regard....
