Visitation rights during Separation

Namasthe, I am a 37 year old person from Bangalore. My wife is 34 years old. Both of us are software engineers. We have male child who is in his 4th year. this is our 7th year of Marriage. We had good and bad times in our marriage, I can say 90% good times and were a very good couple. My wife left our house on Oct 1st 2017, quoting we are not living well. On that day without any information or clue, her parents came with shifting van with helping hands. Their new residence address is not informed to us till now. My wife had changed her address in her bank,my kids school etc even before Oct 1st. It was a planned move.I have reached out to her for revival in a positive manner but her ego and social status is stopping her. She is not corresponding for my requests. But I have my concerns for my kid and need regular visitation. Please guide me for the same. Thanks

Sir,

When you are saying that you are still concerning of your kid then you can file a case under guardian and wardship claiming your kid. Being a father you have a right to proceed to file the case for custody of the child. You are stated everything.

You can approach the court for restitution of conjugal rights. You can also file the required petition for the visitation rights. Once the court has passed an order, then you can visit the child.

You can send an official notice to her through a lawyer after which you can start legal action like restitution of conjugal rights. Another approach would be to contact her or her lawyer and plea for mediation which u can jointly undergo to sort your issues.
