Q: How to get stay of proceedings in criminal cases ?

DEAR SIR, For the criminal case which i have filled in lower court the respondent had brought a stay order in criminal proceedings from high court which says (NOTICE REGARDING ADMISSION. STAY OF FURTHER PROCEEDINGS ONLY TO ENSURE THAT THE CASE IS TRANSFERRED TO BANGALORE). But i didn't receive any summons or notice from high court now the lower court has issued NBW for the appearance of the accused which he has skipped. What should i do now ?

NBW in court refers to a non-bailable warrant issued to arrest someone. It is executed upon arrest or when canceled or recalled by a court order. If the accused is residing outside the local jurisdiction, the police will either arrest them or submit the warrant to the police station in their residing area, as mentioned in the complaint. If the accused still fails to appear, the court may issue proceedings under Sections 82 and 83 CrPC, leading to the attachment of their movable property. Eventually, the chargesheet will be filed, marking the accused as an absconder.
