Seeking divorce from a wife who Is mentally harassing the husband

06-Mar-2023 (In Family Law)
Hi! (Hindu) So my sister in law hid about her past sexual partners, and when we got to know about it few months after the marriage , and asked for divorce, she denied . She had been mentally torchuring my brother by saying either I’ll stay with or you will have to also suffer as I won’t get divorce. We tried to reach out to her family to have a talk with everyone but she is not ready to meet because she knows she has done wrong. She is just making our family suffer. Her family is also saying that it’s her decision and she is only not coming to meet so what we’ll do my meeting up. She is keeping us hanging . December (she was at her moms place ) we got to know about her not so good character before marriage and she lying about it, and for two months she was calling and saying for a chance but she has been lying continuously. And when we said that we don’t want to continue this, she is saying if I won’t be happy , I’ll not keep you happy either. We have her all the call recordings.

I have perused the contents of your query and would advise you to seek a detailed consultancy from a lawyer having expertise in matrimonial cases. There are certain legal remedies available to your brother which you can opt for.

Though the facts of your case question are not very much clear because of poor language but I got the core point of harrasment by your sister in law to your brother and his other family members including you. You are advised to please go ahead with proving adultery case only when you are having good evidence about it in your hand which should be of after marriage and not of the before marriage. you said you hv all her call recordings is a very good evidence against her. provided you take it as an evidence for getting divorce with her. Marriage disputes are always a very delicate matters so you are advised to meet an expert of this line with a good experience of litigation.

hello, if you have all the recordings and proof regarding the torture and cruelty then you can file for divorce under cruelty and also file a complaint in p.s. regarding the same. rest can only be adviced if the further details are known.
