My father got a share from grandfather by 1979 and we are living in that property with father his son and his daughter.he also bought 2 lands by himself,his daughter got married.father wants to gift her daughter the land he purchased by himself but the daughter wants a share of the living property by half.the father don't want to give the property to her instead he wants that living property to be in his son.father is giving almost the equal value of land which he bought.. . Also father is afraid of the son in laws family in previous they used violence against him and son.as a family matter he don't want to fight for a long and trying for a solution in a mutual way.but the daughter needs half of the share from everything he owns now..what will happen if she files a case .. what will be the justice

Hello, No children or relative have any right in a person's self-acquired property while he is alive. Property is not considered as an ancestral property if it was gifted by a father to his son. Therefore, an individual cannot claim his share in a property which was gifted to his father by his grandfather. The property which a son (your father) receives as a gift from the father becomes their self-acquired property. In such cases, the grandchildren have no legal right in property their grandfather gifted to his son which he could have gifted to any other person, too. Such a property is considered as self-acquired property unless there is a clear expression of intention by the grandfather to make it an ancestral property further your facts are not clear so better you call me.
