Residential rights of Woman after marriage in her Matrimonial house

23-Sep-2023 (In Family Law)
Hi, I have filed DV case last year and lodged an FIR for dowry in last month. Thus, Father in law evicted me and my husband from matrimonial house which is self acquired property of Father in law. Although I have a stay order to resides matrimonial home but SDM send me a notice to vacate the premises. My husband is about to file divorce case and he submitted rent agreement to show that he is not residing in matrimonial home but that's not true. He is living with his parents only but they showed in DV case which is filed by mother in law also that I have created nuisance in this matrimonial home but that's not true. Can I take an order to live with my husband's rented flat(rent agreement submitted to the honorable Court) which shows that he is living in rented flat nor with his parents?

yes, why not! you can seek the directions of the court and file the prayer that you want to reside at the place where your husband is residing and the court will be obliged to do that as it is a matter of right and you are the approaching the court under dv act.
