May be you are talking about proof for the grounds for divorce. If you are Hindu, even without proof for any grounds you can seek divorce for irreconcilable differences. Another mode is when both agree on divorce.

You can apply for the divorce if you have any grounds for the same. Besides that you need to show that you are the legally wedded wife of your husband. You can produce the marriage wedding card, registration certificate or other proof for the same.

Question not clear..divorce and child 2 different issues. .
If husband is harassing then give Domestic violence case.
Then proof of marriage will hav to be provided by husband side. .
Don't make child suffer unnecessarily and you require enough grounds fr divorce. .which will not be granted just like that

It is better you just file for maintenance for yourself and child, when court orders for maintenance your husband will come forward for divorce as he has to pay for maintenance, in which case you can get divorce along with permanent alimony .
