If you are a share holder of the said property, you can file a partition suit against other share holders. If you are also legally one of the share holder, then they can't deny your share. You contact any Advocate immediately and they do the needful.

Is the 3rd Party a bonafide tenant. How did he occupy the property? If he is a tenant then you must file a case to evict him from the property.
