It shall be construed as her stridhana and she is vested with unfettered rights to bequeath the property according to her wish. Her absolute right over the property.

Hello. My unmarried uncle (a Hindu) died suddenly without leaving a will. He had self earned properties. He left behind his widowed mother, 4 brothers and a sister. Now who will be the legal heir to inherit his properties? If his mother is the legal heir can she sell or write a will regarding the inherited properties?

As per S.8(a) of the Act, it is the mother who inherits the property of her deceased son; She is competent to bequeath the property through a Will or through any other registered instrument and it becomes valid in the eyes of law.



Q: Husband death property and financial support denied to child & mother

My cousin had been living in US for last few years and she had returned along with 8 years old daughter after couple of years of marital discord and fighting.Child is US citizen.They were living in India without any support from the husband and divorce was not filed.My cousin husband passed away last month and now we realise that all properties earned by him has been transferred to his mother and/or purchased in her name.Also insurance money has been taken by her.Money earned by my cousin and kept in joint account has also been taken by her husband and given to his mother.They are not willing to give any share to the daughter.We are trying to find legal recourse to get the due share.Pls advise what and how things have to be done.

It has to be seen whether the properties stand in your husband's name or his mother's name. It has to be proved that all the properties in the name of the mother are purchased from the proceeds of your husband's income. My husband working in army. Divorce case is going on. But he married another girl. I searched lot but I can't any evidence for his marriage.
