under muslim law both the spouse have to consent for the petition to be maintainable under section 125 CrPC. You can challenge the petition and she can file one under the Muslim Women Protection from Divorce act 1986

Your Wife is entitled to have maintenance under section 125 CrPC. The only remedy available to you is to go and contest. The remedy available to you is only if your case is coming under any of the circumstances of section 128 of CrPC. So for section 125 of CrPC is a secular provision and is applicable equally on everyone irrespective of his/her religion. Therefore the wife is very much entitled to have maintenance under section 125 CrPC.
