My wife got expired 1 year back. Who will be legal heir after I remary

My wife got expired 1 year back. We did not had any children. After few months of wife's death, I got second marriage. Who will be the legal heir of her retiral benefits and Insurance claim? Insurance policy does not have any nominee mentioned. Kindly note we didn't had children.

about the legal heirs your deceased wife, the following persons are the legal heirs
1. sons
2. daughter's
3. husband
these are the class-I legal heirs

if the said following persons are not live then the class-II legal heirs will be entitled

As per law, you would be her class one legal heir. Your second marriage after her death is immaterial for the purpose of acquiring her assets as per law. However for any further legal assistance please feel free to contact

As per Section 15 (1), it shall go, in order of preference:

a) Firstly to sons and daughters, including children of any pre-deceased son or daughter, and the husband;

b) Next, to the heirs of the husband;

c) Then, to the mother and father;

d) Next, to the heirs of father; and

e) Finally, to the heirs of mother

The insurance claim is the self acquired property of the wife and after her death the right will devolve to her first class legal heir. i.e. her child and husband. And since there is no child, the right devolve to the husband.
