My husband is not letting me live in my matrimonial house

Good morning sir / mam ..My husband filed divorce case in 2018 and since then I am living in my father's house . I am getting maintainence of rs 10000 . Later they filed for permanent injunction case on me and my child so that we can't enter that house . nMe and my child want to live in my matrimonial house but they don't allow us to enter. What can I do please tell .. our lawyer is saying that we can't file dv act after such a long period .. please tell other option what can I do to live there .Waiting for your reply .

You can separately file an application seeking place of residence from your husband. However if the matter has already run for 4 years and maintenance has also been granted then the grounds would be different in your case. Complete file needs to be perused to advice better. Feel free to contact

You have got full rights to live in your matrimonial home. And as far as the DV case is concerned there’s no limitation on filing the same. You can demand your residential rights under the DV act and also include the names of your in-laws as well. Also according to the latest SC judgement it doesn’t matter in whose name the property belongs. For more legal assistance I am just a call away.

hello client as i can see your case is very much complicated i agree and accept. in your matter i think along with DV you are alao eliglbe for othwr acses as well for which your husband will also be liabke to be proaecuted
