Mother is claming maintenance from me

my mother asking for money even though she has home or husband and she is 50 year old now and she has done marriage again can she get money from me

Parents have independent right of claiming maintenance from their son. However maintenance is granted to prevent a person to reach the state of penury and to bring luxury. You can challenge her petition on the ground of having in sufficient resources. For further query feel free to contact Thanks

Dear Children are liable to maintain their parents and therefore parents can ask for maintenance. Rest depends on the facts and circumstances of your case. It is therefore advised to take legal consultation.

As per section 125 crpc monther can claim maintenance from the child of she is unable to maintain herself. however since your mother has a home , a husband and has remarried her right to claim maintenance would be limited

If your mother is not liable to maintain herself in her day to day life then yes she can claim maintenance for herself. Yes , she can. Children are required by law to maintain their old parents. The onus to prove that your mother is having adequate means and doesn't require your monetary assistance for maintaining herself If you are successfully able to rebut her claims and prove the same you can rescue yourself from the trap. However if she is really needy and you fail to rebut the claim you shall be held liable to maintain her.
