Got married in 1.5yr ago HMA, marriage has been consummated, but now husband don't want to live with me, in fact his mother and sister forcing him to detach from me, But I want to live. I am issue less.They don't give me single money, while living with husband under the same roof can I get monetary maintenance from court ? No question of divorce. Since then I am forced to live with my parents.
hello ma'am, i have gone through your query. since your marriage has been solmnized for a period of 1.5 years only your husband cannot seek divorce as he has to show the court that parties were living separately for a period of 1 year to get divorce. 2ndly u can claim maintenance even without getting divorced under appropriate sections of Cr.P.C, HMA or DV according to the facts of the case rely. apart from that you can also seek for restitution from the court.

well you can claim maintenance from your husband asto equal of the status you were enjoying while living with your husband. You not have given details or causes of seperately living from your husband. As if you well can prove it with the valid reason you will get Maintinance from your husband. plus while living under the same roof also you can get maintenance for your personal needs of as a prudent lady.
