Marrying again with same person

23-Mar-2023 (In Family Law)
Me and my wife got court married in Kanpur under Hindu Marriage Act last year. I am a Hindu and my wife is Muslim. As my wife's name was changed to Hindu name via only affidavit (No newspaper ads, etc) to get married, we are now facing issues in using that marriage certificate because on all my wife's documents, she has her original muslim name. I don't want her to be converted as we respect each other's religion. We are now looking for getting married again via Special Marriage Act to overcome this issue. Would it be possible? If yes, what are the steps?

Yes…you can get married under the special marriage act. In the marriage registration process the only difference will be in special marriage you need three witnesses. You can opt for both online and offline mode. For more legal assistance I am just a call away.

You have already married her by changing her religion in Hindu. Now reversing the same would be futile if you are only facing issues over documentation. You can simply file a declaration suit for resolving these issues. For any further legal assistance please feel free to contact

Thanks

The step are
1.check the eligibility
2.reach out to the concerned marriage officer in which you have to serve the notice with relevant documents to the marriage officer 30days i.e,one month before the intended date of marriage.
3.public notice and objection:- both parties are required to be present after the submission of documents for issuance of public notice for inviting objection after that the office manager post one copy of notice on the notice board of the office and other copy of notice will send to both parties as per the given address.
4.registration is done after the one month of notice .both parties with 3 witness are required to be present on date of registration along with documents .
