Leave out name in heirship Certificate

23-Jul-2023 (In Family Law)
Hello Law experts, nMy name was intentionally omitted in my father's heirship certificate after his death. My father has two children, myself and my brother. I live out of the country and I was not aware of this until very recently I learnt that my brother and my mother are his only heirs But I have other documents like my birth certificate, community certificate to prove the heirship. Is omitting my name in the heirship certificate punishable in the court of law? nI would also like to get a copy of the heirship certificate. How can I do so while I live out of the country. nThanks in advance for your time

It is illegal to leave out one of the legal heirs from the legal heirship certificate. You can file a complaint to the tahsildar of your area from where the legal heirship certificate was obtained by your brother. If all documents are in order then suitable action will be taken. You can also file a cheating case before the court.

Writs are a written order from the Supreme Court or High Court that commands constitutional remedies for Indian Citizens against the violation of their fundamental rights. Article 32 in the Indian Constitution deals with constitutional remedies that an Indian citizen can seek from the Supreme Court of India and High Court against the violation of his/her fundamental rights.
