I want to live far from my wife due to her fighting habits

13-Jan-2023 (In Family Law)
I got marriage in June 1994.We have son 23 yr&daughter 21 yrs.In 2003 my wife started a lot of quarrel due to doubts. She got depression after that police complaints, women cell complaints, stay away from home with valuable documents-cash-jewelry-documents etc. Some time stay away with both children some time one child.Life is going in hell since she got schizophrenia, bipolar disorder and all related problems.Due to my introvert nature, future of our both children or fear to be alone,I could not separate till that date in spite of many times she out me from home which we have purchased in her name from joint saving account. Our son has completed his M-tech and our daughter has completed only 12th.Children could not appose her prperly but they know-it is wrong. Now family members, relatives and friends make the distance.I have lost my patience to stay with her.If I stay alone in rented or self purchased house. What she has right, does she enter forcefully in my house.I can pay for her needs.

you can file a petition under sec 10 of hindu marriage act before the family court having jurisdiction for the same and she will be forced to live separately for one year and after that you can file divorce petition also.

Dear client, If you shifted to rented accommodation or self purchased house she can't enter force fully in that house. Another option available to you is mutual divorce if she agree on reasonable terms and conditions. Dear client for more clarification u can contact me and I m happy to help u.

Query perused. I would advise you to file a petition under section 9 of the Hindu Marriage Act for Judicial separation taking the grounds of cruelty and her disease. For further consultancy and legal services you may contact us.
