PRAYER HENCE THE APPLICANT HUMBLY PRAYS 1. to take cognizance for the offence punishable u/s 498A IPC and punish Respondent1 to 3 as per law and extend police protection to the deponent, 2. Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-. 3. Pass orders u/s 18, in totality against Respondent1 to 3, 4. Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children. 5. Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent1 as he is residing in the house of respondent No. 3, which is legally prohibited, 6. Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent1 falsely filed Divorce Petition. 7. I am married from 2 years 2 months, I always wanted a child and was trying to convince my husband for that but he and his family always used to refuse for that. Now because my husband and his family is blaming me for cheating on my husband on the basis of WhatsApp chats they want divorce from me. From last 2 years for each and every small or big fights they were asking divorce I was mentally tortured and abused by the family. Now they used to call my parents threatening them and saying if you will not give divorce easily we will spread videos, photos, chats in all the relatives. They thrown me out my house I lost my job because I don't have accommodation in Bangalore. I tried to go to my house but they doesn't allow me to come. I'm so much scared and mentally disturbed I feel to do suicide because of my husband and his family. My parents are also mentally tortured by them,my father is suffering from high blood pressure. Is there any law if husband refuse for having child intentionally. Respected As i gone through the facts. In that they are blackmailing you by video and chats. I need clear expiation with regard to the same. You can file the DV case against them for time being. Before that please talk to me and explain the problem faced by you. Dear client good evening, in your case as you said torture by husband n his related person, it's totally offense committing by themselves. marrital relationship is bound by the duty your husband, if not cruelty by them, how many days you out of by home, you have chances to get relief.
