Husband not ready to register the marriage how can we proceed

My sister recently got married in Feb'16 to a divorced man. He already have a 7 yrs old daugther with his custody. Marriage took place in a guruduwara in boy’s city in Delhi.Soon after the marriage her inlaws(mother & sisters) started to dominate her & created domestic problems.They told my parents to take her back. My parents & brother tried to mediate the situation and things are in little control now. Now Issuee is ::My sister & parents have several times talked with Groom to register the marriage legally but he is not initiating the process. What steps we could take in this situation?

Have you checked whether he is duly divorced or not? His refusal is creating doubt in my mind. We can register your marriage but for that purpose you have to convince him. Marriage cannot be registered solely by one party. Documents like ID proof and address proof are also required. You can't force anyone for this. If the said guruduwara has issued a certificate. That is sufficient to prove the solemnization of marriage. If you want to take any action against husband or in laws. You can do so. Marriage certificate is not required.

The registration of marriage is not mandatory under the law of India.
As you informed that your marriage took place in gurudwara in the presence of some witness than no body can denied and your sister is legally wedded wife in eye of law.
On the other hand even than your sister want registration of marriage than she may approach to civil court for same.

for regd of marriage I havae to file joint application with regd of marrisge there after I have to appear before the marriage registration officer3 and make statement for marriage alone marriage can not be regd I can file a complaint against him

Look non-registration of marriage alone does not nullify married state. If the couple have lived together with intention and purpose and meaning of marriage then they are 'married' only. Registration of marriage is done for the evidence only which can be proved by a Lawyer otherwise also, so need to worry, but try to peruse the groom to register his marriage.

Mam,

Tell your sister to collect the sufficient evidence for future safety purposes. I mean take the gurudwara certificate of the marriage, Tell her take the neighbors in her confidence if their help is required in future.
