Husband doesn't give money and is actually torturing me

My husband is a govt employee in ministry of external affairs (foreign ministry).he is from delhi(haryana)and I m from Rajasthan.He has been torturing me physically, financially, emotionally and mentally for the last 11 years of our marriage. He doesn't give me a single penny in my hands and doesn't let me do a job either. Finally I have come to my parent'shouse along with my 10years daughter. He refused to give me my gold and any mony for our maintenance. He said he will never give divorce. I don't want to live with him at all under any circumstances. Now what should I do to get my and my daughter's right . I want maintenance money for my daughter's upbringings and education. What options do I have ? We are hindu by religion.

You can Lodge FIR against him for harassing you. You can also claim for maintenance for you and your daughter. You can also claim your gold and other items. He has to give maintenance for both of you. Court will stop his salary. Rest assured.

Mem ap apke husband ke against domestic violence.dowry.breach of trust ke cases file kare.... uske baad ap maintenance ke liye bhi apply kar de... Apko divorce ka case baad me file krna hga.....

You are being harrased by your husband mentally ,physically , and financially. If he is a service man than there is no problem.you can file a case under section 125cr p c for maintenance for you and your daughter. You can write directly to his head of departmwnt and ask him maintenance. You can also file a case undwr donestic voilence act for maintenance. You can also file a case gor dovorce in family court and ask expenditure for case. You n your daughter to be maintained it is his primarily duty.also you can file a case for harrasement and dowry demand.

madam,In these days more ways to get relief like in these circumstances, so you can go for domestic violence (DV Act cases) case against your husband, you can move an application under section 125 of the crpc for maintenance. it is also that in DV act case court can order to protect you and can make order to your husband to give you money for all needful and it is also that you can file your DV case at your present address where you are residing. You have to discuss with your lawyer for other reliefs as you can get.

Available legal options for you:
A. File for divorce under section 13 of the Hindu Marriage Act. Please note that you can file for divorce at the place of solemnization of marriage OR at the place where you have been residing with your spouse continuously for 6 months prior to separation.
B. File for maintenance under section 125 Cr. P.C. along with application under Prevention of Domestic Violence Act, 2005.
C. Also, please file for custody for your child under Guardians and Wards Act.
D. Register FIR under Section 498-A, 406 (for gold ornaments and stridhan) IPC.
