How to get Jewelry back from in-laws in a matrimonial dispute?

I have been living separately from my husband since the time of my pregnancy. Now i have a small one month old daughter. Now they have sent me a legal notice through advocate asking me to come back and live with them and simultaneously they have called us and used abusive language against me and my parents. I want to get all of my belongings which are lying there like my clothes and jewelry, what can i do

If do not longer live with your husband than you can file case against your husband in criminal case in section 498a,406 I.p.c. this help you getting jewellers and clothes along with all material which gives in marriage.you can also file domestic violence act case against husband.

U can file a case in the court against ur husband under section 406, 498A IPC and also domestic violence and 125 CRPC for mentinens for u and ur child.Ur husband have not legal right to send notice you.

your husband has sent you a legal notice through his advocate and he wants to file a case u/ s 9 hindu marriage acts soonly. so you do one thing , you file a case against him u/ s 498( a), 406 ipc and get your belongings back.as soon as your case will be filed police will recover your all items back from them. so you have to file a case u/s 498(a),406 ipc and also you file case u/s 12 n 23 of domestic voilence act.

Dear madam as per your query and according to law firstly you send reply of legal notice because this notice under section 9 hindu marriage act protection of many cases if you file proper jurdiction against your laws and husband criminal with mentenence also domestic violation.then after you file a criminal complaint before police station for dowry and cruelty.

if you dont' like to reside with your husband then immediately replied to the legal notice and averred all the things in the reply that you are not interested to live with him due to his behavior or any Genuine reason. You can filed a complaint under The Protection of Women From Domestic Violence Act 2005 in the competent court . As per section 3 of the Act defines Domestic Violence so if you are abused by Physically and mentally then you can approached the competent court. And you demand all your belongings and jewelry.
