How to file contested divorce from husband

I was married 8 months before. My husband was posted at some another place.i lived with my in laws for about four months. I am a working girl. I had applied for transfer request on spouse ground n got transferred. But my heart doesn't allow me live with him. I don't want to be with him anymore. The family including my husband treat girls much rude.they tried to take all my salary. I won't be able to live with him anymore and want to file divorce.i don't think he will be ready for mutual consent. Please guide me how to proceed. What reasons doest court accept for filing divorce.i am from trauma and doesn't want to even see him

On ground of cruelty you may seek divorce but after passing of 12 months of your marriage. Question arises here that whether you maintenance from your husband or simply divorce or you may file criminal case under section 498a i.p.c. to make pressure upon them to get divorce

You can file divorce in your concerned family court which is available in civil court.
After discussion with you I can only suggest suitable ground of divorce.

You can file a petition for divorce under section 13 of hindu marriage act. The problem you are suffering is called "Crulity" in the legal sense. Hence, you can file your divorce petitition on the ground of "Crulity".

You can file a divorce on a ground of cruelity against your husband. There are several cases in which court usually give divorce on the ground if cruelty but you can only file a divorce case after online year of Marriage.

Regarding your query you can not file a divorce petition within one year of marriage.you have a better option of Domestic violence Act. After that your wish you can file a divorce petition with a ground of cruelty.
