How to deal with abusive father

30-May-2023 (In Family Law)
What legal action can be taken in India against a father who emotionally traumatises his children with threats, verbal abuse and other forms of non-physical harassment? I am 17+ with siblings who are 18, 13 and 4 year old. He is not providing us with any finance whatsoever including for education for the past year and on going. We live with our mother who is hardly able to support us and is still looking for a job. He is influential enough to stop a Maulana from moving ahead with Khula proceedings and refuses to give her divorce. Keep in mind that these threats etc. are not for the purpose of disciplining the child in any sort of a sane, rational manner but more because of other reasons like biases, prejudices, conflicts with spouse etc. These threats may also be about future physical abuse and/or they may consist of fear tactics to control the child's mind to adhere to the norms/values and/or wishes of the parent which have no rational basis.

please know that the immovable property acquired by your father by way of gift and so it is his self acquired property,
ill treatment to your mother, if she is aggrieved she can approach the advocate for the reliefs, which she need.
It appears that you have good brain. Use it you can get financial assistance by yourself. you are not entitled to relief from your father. God helps those who helps themselves. Good Luck.

Since the property is a ancestral property, you all have right in share of the property. Further you can suit for partition suit. Further he cannot sell this property with out informing you all. You can also give police complaint.

See,
In your case as you informed that your father own property from their parents. As yout told it was the gifted property them he will be the absolute owner.

Here your mother can take shelter in the said house as she is legally wedded wife. In case if it was done only your mother can take maintenance because as per new rule father can restrain his son if he was claiming his self acquired property.
