How can father claim maintenance from Chilren

I am a retired person with very little pension. In my last years of service i had jointly built a house with all my savings and some amount of contribution from my daughters. For some years after retirement i had let my daughter to live in that house without rent and after 3years when i have no income, asked for minimum amount as rent for my lively hood. But now she and her husband are not paying the rent properly and claiming their ownership in my property. Can i file a law suite against them and ask them to vacate as the property is in my name legally. Pls advice

Yes in this case you can file a suit for eviction of your daughter and son in law from the house which is of your ownership and further as you stated that she is not paying you and you have less income so for that you can file a case of maintenance under section 125 of crpc. Yes. You can file suit for eviction and possession, Since the property is in your name. Further if, the property is your self acquired property, then your daughter doesn't have any right to claim share in your property. You have stated that she is contributed some amount to build house, if that is the case then burden of proof lies on her. She should produce sufficient documents to show her contribution. Even the she is entitled for recover of her contribution not share in the property.

The scope is under the Sr Citizen Welfare and Maintenance Act. you can also invoke Section 125 of the Code of Criminal Procedure, 1973.
Please have the advise of advocate. your are not without remedy.
your question does not disclose as to who is the owner of the site and its acquisition. your problem could be easily remedied only after personal hearing.
