Girl marries by fake educational qualification & acquires property

Hi , One of my friend who lives in USA got married to a girl through marriage beuro agency in India...Both are Muslims by religion. ..while marrying girl's father told boy that his daughter is graduate and well educated infact she is not even 10th pass...the boy later on came to know about this fact ..meanwhile he had baught a flat worth 1 cr in India for girl so that she can live there untilll visa formalities are completed. ..that girl started living with her parents now that boy doesn't want to live with her n't continue relationship but girl is not living property. ...what can 'be done in this case so that the boy gets his property back and get rid of girl too. Please answer as early as possible. Thank You
You have not mentioned the date and place of marriage? however as both of muslims and if the marriage is not registered it would have to be dissolved as per the Mohammedan Law. However, if they desire they file a petition for Divorce too but being a NRI he should know that maybe his physical presence maybe required, if Divorce case is filed in India. If house is on EMI he can stop paying EMI and automatically the Bank will evacuate them and seal the house. Thereafter, a Notice would have to be sent to the girl for divorce and then file a petition.
