Defame case possible on charges imposed in Senior Citizen Case?

My Sister's Mother-in-law filed a senior citizen case against her and imposed many charges (even on character) without any proof. We have proof for all charges. Can we file a defame case against her based on false charges she mentioned in her Senior Citizen Case?

Hi The first step should be to file a quick reply / WS in the case in which you have been accused of. It is imperative that the same may be done within 60 days of you receiving the notice. No Only on winning the case you can file a case for malicious prosecution and defamation as well. You only have to contest the case till the time of disposal of case. If you will be able to prove the case after that you can proceed in the manner you want yo proceed.

Yes you can successfully file a complaint case against the mother-in-law and book her under defamation. But first of all you need to file a written complaint with the police station of your area regarding your grievances. For more legal assistance I am just a call away.
