Questions Answered by Advocate Anubha (100+ answers)

Q: Is sexting with mutual consent on WhatsApp and later blackmailing considered a crime in India?

Sir, I am 42 years old and have engaged in sex chats on WhatsApp with a lady with mutual consent for 2 months. She even invited me to book a hotel room for the night, which I did not do. At her request, I sent her two videos of myself masturbating without showing my face. Now, she is blackmailing me with threats to complain against me in my department. I am a government employee. She is also demanding money to keep silent. I have never met her or seen her in person; all interactions have been on WhatsApp only. Sir, what should I do now to protect myself and my job?

Advocate Anubha answered
Though sending sexual material is offence unless its with consent. Donot worry, you must be having conversation to establish the proof that all chats were with her consent. You can even tell her that you can complaint against her for blackmailing you.

Q: Wife Filed fake case in CAW because I revolted against her 1st marriag

I am posted in Kolkata, used to stay in Delhi with my wife. I came to know about her 1st marriage and divorce hence I revolted. Then our family met and had a big quarrel. She filed fake domestic violence case against me and my family at CAW Cell. Then she also filed a case in Family Court. Its been a month now. Now I received a date from CAW Cell and the court as well. I want to fight the case in the court. Should I also go to CAW Cell or only respond to them that matter is in the court now?

Advocate Anubha answered
As a law abiding citizen, you should visit CAW, it will keep your image in a better manner. Tell them politely; that you would like to contest the case; as you are not guilty.
