Child Maintenance and laws in india and uk
30-Jul-2023 (In Family Law)
Hello there I need to understand that I am currently in UK and pay maintenance towards my child and separated from my wife. If I come back to India what will be my options in terms of pa?ying maintenance towards my child as India comes under reciprocal law with UK
Sir, maintenance is granted on the basis of income of husband. If u come to India, again the maintenance would be upon ur income. U can apply for modification of maintenance granted on the basis of changed circumstances and change in income to lower side if any.

You have to pay according to the order of the court which passed that order. If your earning capacity decreased after came to India then you can move an application in that court which have passed the order to decrease the amount of mantainance.

Any foreign decree are not im perse enforceable in India. Decree holder have to file execution of decree in India.
So if you are to come India then you will not be entitle to pay Maintenance as per order of foreign court. In India you have remedy to file suit for declaration that " foreign decree is null and void on did and as grounds"
Police authority Neither can arrest Nor take Any action against you.

You must be paying maintenance of your child as per the order of India Hon'ble Court and coming to India does not make any difference in the order of maintenance already granted. Moreover, the kid is your own child and anything you are doing is entirely for his benefit. If you are interested in custody of your child that may be done.
