FMC may establish the family/membership details, but a bank may require a Legal Heir Certificate for its records and release of the deceased’s account or benefits. If insisting without legal basis, seek written reasons and challenge the demand.

If the bank is insisting on a Legal Heir Certificate despite submission of a Family Member Certificate (FMC), ask the bank to provide the requirement in writing and specify the applicable policy/rule. A Family Member Certificate may not always be treated as equivalent to a Legal Heir Certificate for every banking or asset-transfer purpose. If the bank’s demand is unreasonable, you can submit a written representation to the bank’s grievance officer and thereafter approach the appropriate banking grievance mechanism.

yes this has become mandatory because so many cases are erupting with in family due to clases latter on so it has become mandatory for legal heir, apply for legal heir certificate...if you are in hyderabad and surrounding let me know I can help you out

First, you must send a legal notice to the bank. Subsequently, you need to file a petition in court seeking a succession certificate, naming the bank as the opposite party. Once the court grants the succession certificate, the funds held by the bank will be released to you.
