Questions Answered by Advocate Mrudhula Jahnavi (200+ answers)

Q: Withholding of Original Educational Certificates by College

My college is currently withholding my original educational certificates. I would like to understand whether the college has the legal right to retain my original certificates and what legal remedies are available to me for getting them back. I would also like to know whether any applicable UGC/AICTE regulations or other laws prevent an educational institution from retaining students’ original documents, and what steps I can take if the college refuses to return them.

Advocate Mrudhula Jahnavi answered
Educational institutions generally should not retain students’ original certificates merely as security for fees or other obligations, particularly where applicable UGC/AICTE rules prohibit such retention. You can first make a written request for immediate return. If they refuse, the appropriate remedy may include a complaint to the affiliating university/regulator and, depending on the facts, legal proceedings for recovery of the documents. Please share the college details and course for a specific remedy.

Q: I want to file insolvency petition

I have around 14 laks of loan from several payday loan apps and 7 lakhs from friends. I am unable to pay now and my monthly income is 60k. What to do legally.

Advocate Mrudhula Jahnavi answered
If you are unable to repay the loans, do not ignore the lenders or take fresh loans to repay existing ones. Prepare a complete list of loans, outstanding amounts, interest and repayment dates, and approach each regulated lender for restructuring or a settlement plan. If recovery agents are harassing or threatening you, preserve the evidence and seek appropriate legal relief. Please share the loan details for a proper legal assessment.

Q: Non Payment of Dues by defandant against money suit

How can we Proceed further in favour of petitioner in Money recovery suit for the non payment of dues against their work done 2years ago. already got a Decree in favour of Petitioner to recover the nonpayment due including interest by defandant. in a Exparte decree , in Arbitration, How to Execute that decree before the Court

Advocate Mrudhula Jahnavi answered
If the arbitral award/decree is already in favour of the petitioner and has become enforceable, you can initiate execution proceedings before the competent court under Section 36 of the Arbitration and Conciliation Act, 1996, read with Order XXI CPC. Depending on the facts, you may seek attachment of bank accounts, movable/immovable property, salary or other assets of the judgment-debtor. Please share the award/decree and details of the respondent’s assets for guidance on the appropriate execution procedure.

Q: Legal Advice for Recovery of ₹50,000 Hand Loan from Borrower/Surety

I gave a ₹50,000 hand loan in January 2025 under a signed agreement, repayable within three months with agreed interest . The surety also signed and agreed to repay if the borrower failed to pay. The amount remains unpaid, and both are currently unresponsive. What legal action can I take to recover the outstanding amount from the borrower and/or surety? How much money i need to spend for recovering the same.

Advocate Mrudhula Jahnavi answered
Since you have a signed loan agreement and a signed surety undertaking, you can issue a legal demand notice to both the borrower and surety and thereafter initiate appropriate recovery proceedings. The surety’s liability depends on the exact terms of the agreement. Please share the agreement to assess the claim, interest and likely recovery costs.
