Advice needed regarding alimony in divorce proceeding

14-Nov-2023 (In Family Law)
My husband is divorcing me. We are both Hindus and have no kids. We have been married more than 15 years. His yearly net profit is above 15 crore rupees, and much more than that in assets. I have no income, some small savings and almost no assets. I have 3 questions: 1) What range of alimony would be reasonable? 2) How long would it take for me to be awarded alimony? 3) In the interim period while the case proceeds, how much money in terms of maintenance would be reasonable? I am only looking for approximations or a range of numbers; I understand the answer to these questions could be "it depends"; I'm just looking for estimations and/or advice.

In this regard, i directly want to convey that there is set formula of calculating alimony which Courts follow and has been expounded in several judgments of Hon'ble Court. Further, reasonableness of the alimony depends upon the maintenance you get from the Hon'ble Court. Therefore, it is advisable to institute and take legal course in calculative way, so as to hunt best possible money from your husband. 2) Your alimony would only be awarded, when your marriage dissolves particularly when your status as wife is severed from him. 3) Generally, Courts at interim stage within 3 months from the institution award interim maintenance, which in case would be handsomely as your enlightenment is whooping big. That the quantum of maintenance will always depends upon the income affidavits which you both parties are obligated to file in the court for adjudication of the claims. Perused your legal query. So far as net profit is concerned it seems to be of a company being run by your husband. The taxable income to your husband would be considered for granting and freezing alimony and maintenance. Normally 25 % of the income be granted as maintenance and considered as just and reasonable.
